Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you (“you”, “User”) and MyMedica (“MyMedica”, “we”, “us”, “our”), operated by a sole proprietor (ФОП) registered in Ukraine. The Terms govern your access to and use of the MyMedica website, mobile interfaces, application programming interfaces, and related features (collectively, the “Service”). By creating an account, accessing the Service, or paying for a Subscription on or after May 25, 2026, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree with any part of these Terms, do not use the Service. Where you use the Service on behalf of another person or organization, you represent that you have authority to bind that person or organization, and “you” refers to both you and that entity.
1. Acceptance of Terms
By creating an account, signing in, uploading content, or making a payment, you agree to these Terms and to our Privacy Policy, Refund Policy, Acceptable Use Policy, and Cookie Policy. Continued use of the Service following any update to these Terms constitutes acceptance of the updated Terms.
You must be at least 18 years old to create an account. Residents of the European Economic Area (“EEA”) aged 16 or 17 may use the Service only with the verifiable consent of a parent or legal guardian, who agrees to be bound by these Terms on the minor’s behalf. We do not knowingly accept users under 16. If we learn that an account belongs to a person under 16, we will suspend the account and delete associated data, subject to legal retention requirements.
Acceptance is recorded electronically at signup and at the moment of each paid checkout. You waive any defense based on the electronic form of these Terms.
1A. Geographic Restrictions
The Service is not available in jurisdictions subject to comprehensive sanctions or embargoes maintained by Ukraine, the European Union, the United Kingdom, or the United States. By creating an Account or paying for a Subscription, you represent that you are not located in, ordinarily resident in, or accessing the Service from: the Russian Federation, the Republic of Belarus, the Islamic Republic of Iran, the Democratic People’s Republic of Korea (North Korea), the Republic of Cuba, the Syrian Arab Republic, or the temporarily occupied territories of Ukraine (including the Autonomous Republic of Crimea, the city of Sevastopol, and the non-government-controlled areas of the Donetsk and Luhansk regions). You further represent that you are not listed on the U.S. Treasury Department’s Specially Designated Nationals (SDN) list, the EU consolidated sanctions list, or an equivalent list maintained by Ukraine or the United Kingdom. We reserve the right to refuse service, suspend access, or terminate any Account whose use violates these restrictions, and to deny refunds for periods of use that took place in violation.
2. Definitions
In these Terms, the following capitalized terms have the meanings given below.
- Service means the MyMedica platform, including the website at mymedica.me, the mobile and web application, the document organizer, the AI extraction features, the visit one-pager generator, customer support, and any other features we make available.
- User or you means any natural person who creates an account or otherwise uses the Service.
- Account means the authenticated identity associated with your email address through which you access the Service.
- Content means any data, files, documents, photos, scans, lab results, notes, text, identifiers, and metadata you upload, enter, or generate through the Service, including documents the AI processes on your behalf.
- Subscription means a recurring paid plan that grants access to features marked as paid.
- Freemius means Freemius Inc., a Delaware corporation (USA) located at 4023 Kennett Pike, Wilmington, DE 19807, which acts as the Merchant of Record for paid Subscriptions.
- EU Consumer means a natural person resident in the European Economic Area who uses the Service for purposes outside their trade, business, craft, or profession.
3. Account and Security
You are responsible for maintaining the confidentiality of your credentials, including passwords, magic links, and any device-bound authentication factors. You must use a unique password for the Service and you must not share your Account with any third party. All actions performed through your Account are deemed to have been performed by you.
You must provide accurate and current information when creating the Account and keep it up to date. You may not impersonate another person, create an Account using a false identity, or maintain more than one Account without our prior written consent.
If you suspect or become aware of any unauthorized use of your Account, any disclosure of your credentials, or any other security incident affecting your Account, you must notify us at support@mymedica.me without undue delay. Until you notify us, you remain responsible for activity carried out under your Account, except to the extent prohibited by applicable consumer law.
We may require additional verification before granting access to sensitive features, including but not limited to data export and Account deletion. We may suspend or limit Account access if we detect activity that, in our reasonable judgment, indicates a security risk to you or to other users.
4. Permitted Use and Restrictions
The Service is licensed to you on a personal, non-exclusive, non-transferable, revocable basis for your own use in organizing and presenting your medical records. You may also upload documents of a child, parent, or other person for whom you act as a legal representative or with whose explicit informed consent you act, provided that you can document such authority on request.
You agree not to:
- Upload medical records or any other personal data of a third party without that person’s verifiable consent or without lawful authority to act on their behalf.
- Use the Service to store, generate, or transmit content that is unlawful, defamatory, fraudulent, infringing, or harmful.
- Probe, scan, or test the vulnerability of the Service or any associated network or system, except under a security disclosure program we publish.
- Circumvent, disable, or interfere with security features, rate limits, authentication mechanisms, or usage controls.
- Use bots, scrapers, headless browsers, or other automated means to access, copy, or extract data from the Service, except for accessibility tools used by an authorized user on their own Account.
- Resell, sublicense, or commercially redistribute access to the Service or any output of the Service.
- Reverse engineer, decompile, or attempt to derive source code from the Service, except to the extent expressly permitted by mandatory applicable law.
- Use the Service in a manner that creates undue load, including sending automated AI requests in excess of documented limits.
- Use the Service to develop, train, or fine-tune a competing artificial intelligence model.
Violations may result in suspension, termination, refusal of refund, and, where appropriate, referral to law enforcement.
5. Subscription and Billing
Some features of the Service are available only under a paid Subscription. Prices, billing periods, and feature inclusions are displayed at checkout and in your Account settings.
We offer Subscriptions under multiple tiers (currently Care and Treatment) and billing periods (monthly, annual, and time-limited launch promotions). Annual Subscriptions include a recurring Welcome Backfill — a bonus document-upload allowance granted each annual cycle and valid for thirty (30) days from activation. Launch promotions, when offered, include a one-time Welcome Backfill and are limited to one purchase per customer; subsequent purchases of the same launch SKU may be declined. The Welcome Backfill is separate from, and does not consume, the standard monthly document allowance, and does not roll over between cycles. Eligibility for the Welcome Backfill on future Subscriptions may be affected by prior refunds — see the Refund Policy §5A.
Freemius Inc. (Delaware, USA) is the Merchant of Record for paid Subscriptions. Freemius handles checkout, payment processing, tax calculation (including VAT, sales tax, and other indirect taxes where applicable), invoicing, payment dispute and chargeback handling, and refund disbursement. By purchasing a Subscription, you also accept the Freemius Terms & Conditions of Sale and Privacy Policy, which apply alongside these Terms. Freemius will appear as the merchant on your card or bank statement — typically formatted as FS * MYMEDICA or similar; the exact format depends on your issuing bank.
Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date. For annual Subscriptions, Freemius sends a renewal reminder email approximately 30 days before the renewal date — this is a courtesy; the responsibility to cancel in time rests with you. You may cancel at any time through the Freemius User Dashboard (linked from your order confirmation email), from your MyMedica Account settings, or by contacting support@mymedica.me. Cancellation takes effect at the end of the current paid period; you retain access until that date.
We may change Subscription prices, features, or billing cycles. For active paying users, we will provide at least 30 days’ prior notice of any material change by email and through the Service. If you do not accept a price increase, you may cancel before the change takes effect; continued use after the effective date constitutes acceptance of the new price.
If a payment fails, Freemius will retry under its standard dunning schedule. We may suspend paid features after a reasonable grace period (no less than 7 days from the first failed charge) and may downgrade your Account to a free tier or read-only mode. You remain responsible for any unpaid amounts.
Invoices are issued by Freemius and made available through the Freemius User Dashboard linked from your order confirmation email and from your Account settings. For questions about specific charges, contact support@mymedica.me; we will coordinate with Freemius on your behalf where needed.
6. Medical Disclaimer
The Service is a document organization and presentation tool. It is not a medical device, not a diagnostic system, and not a substitute for professional medical care.
MyMedica does not diagnose conditions, does not prescribe treatment, does not provide medical advice, and does not establish a doctor-patient relationship. The one-pagers, timelines, extracted facts, and summaries generated by the Service are informational aids intended to help you and your healthcare provider organize and discuss your records. Clinical decisions must always be made by a licensed healthcare professional based on a full review of original source material.
In a medical emergency, call your local emergency services immediately. Do not rely on the Service in any time-critical situation.
AI extraction is not perfect. The Service may misread numbers, confuse dates, omit findings, mistranslate clinical terminology, or generate incorrect summaries. Before relying on any output, you must verify the information against the original document. By using the Service, you accept that you remain solely responsible for the medical decisions you make and for sharing accurate information with your healthcare providers.
7. AI Service Disclaimer
The Service uses third-party AI models, including but not limited to those provided by Anthropic, PBC (“Anthropic”), through the Claude API. We have configured the Anthropic integration with training opt-out, meaning your Content is not used by Anthropic to train its general-purpose models, subject to Anthropic’s published policies.
We do not warrant that AI output is accurate, complete, current, fit for any particular medical or non-medical purpose, or free of bias. AI output is provided on an “as-is” basis. You agree to treat AI output as a draft for human review, not as a final clinical or legal conclusion.
AI features may be temporarily unavailable due to upstream provider outages, rate limits, or model deprecations. We will attempt to maintain reasonable continuity, but we do not guarantee that any specific model version remains available.
8. User Content and License
You retain all rights, title, and interest in and to your Content. We do not claim ownership of your documents, facts, summaries, or any data you provide.
You grant MyMedica a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, reproduce, process, modify (only for technical purposes such as format conversion and AI extraction), and create derived data structures (such as extracted facts and one-pagers) from your Content, solely to provide the Service to you and to fulfil our obligations under these Terms. This licence ends when you delete the Content or your Account, subject to short-term technical backup retention described in the Privacy Policy.
You may delete individual documents and facts at any time. You may delete everything in your Account through /account/delete-everything. Erasure is irreversible after confirmation. Backups containing residual copies are purged on a rolling basis no later than 30 days after deletion, except where retention is required by law (for example, tax records linked to payment events).
You represent and warrant that:
- You own or have the necessary rights to upload the Content.
- The Content does not infringe any third party’s rights, including privacy, intellectual property, or confidentiality rights.
- You will not upload Content that you know to be inaccurate in a way that could harm another person.
9. Intellectual Property
The Service, including its software, source code, design, user interfaces, models we fine-tune, brand names, logos, and documentation, is owned by MyMedica or its licensors and is protected by intellectual property laws. Except for the limited licence to use the Service granted in these Terms, no rights are transferred to you.
You may not remove, alter, or obscure any proprietary notices, copyright marks, or trademarks displayed in the Service. You may share screenshots and outputs that contain your own Content with your healthcare providers and within your own personal or professional circle, but you may not republish the Service interface or branding without our written consent.
Feedback you voluntarily provide may be used by us to improve the Service. You grant us a perpetual, irrevocable, royalty-free licence to use such feedback without obligation, but we will not attribute feedback to you publicly without consent.
10. Service Availability
We use commercially reasonable efforts to keep the Service available, but we do not commit to a specific uptime target and do not offer a service level agreement (“SLA”) at this stage. The Service may be unavailable from time to time due to maintenance, upgrades, third-party outages, force majeure events, or unforeseen technical issues.
We may modify, add, or remove features at our discretion, provided that material reductions in paid features are accompanied by reasonable notice and, where required by applicable consumer law, a refund or proportionate reduction in price.
11. Suspension and Termination
We may suspend or terminate your access to the Service, in whole or in part, if:
- You materially breach these Terms or the Acceptable Use Policy.
- We are required to do so by law or by a competent authority.
- Continued operation of your Account presents a security or legal risk.
Except in cases of severe abuse, fraud, or legal compulsion, we will provide reasonable notice and, where appropriate, an opportunity to cure the breach. EU Consumer rights to terminate for serious operator default remain unaffected.
You may terminate your Account at any time. After termination, you have at least 30 days to export your data through the Account export feature or by request to support@mymedica.me. After this window, we will erase your Content according to the Privacy Policy.
Sections that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution) survive termination.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation.
EU Consumer carve-out. Nothing in this Section limits or excludes the statutory rights of EU Consumers under mandatory law, including rights of conformity, the Digital Content and Digital Services Directive (EU) 2019/770, and national implementations thereof. Where a statutory warranty applies, it applies in addition to the contractual terms.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- Our total aggregate liability arising out of or in connection with these Terms or the Service, regardless of the form of action, is limited to the greater of (a) the total fees you paid for the Service in the 12 months immediately preceding the event giving rise to liability, or (b) 100 EUR.
- We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of business, loss of data (where data loss results from a circumstance beyond our reasonable control), or loss of goodwill.
- We are not liable for medical outcomes, clinical decisions, or any consequences of acting on information presented through the Service.
Mandatory carve-out. Nothing in these Terms limits or excludes liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) gross negligence or willful misconduct; (iv) any other liability that cannot be excluded or limited under applicable law, including mandatory EU consumer rights and Ukrainian consumer protection law.
14. Indemnification
You agree to indemnify, defend, and hold harmless MyMedica and its operator, employees, contractors, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your Content, including any allegation that the Content infringes the rights of a third party.
- Your use of the Service in violation of these Terms, the Acceptable Use Policy, or applicable law.
- Your breach of any representation or warranty in these Terms.
- A third party acting through your Account due to your failure to protect your credentials.
We will notify you of any claim, allow you to control the defense (subject to our right to participate at our own expense), and reasonably cooperate. You may not settle any claim in a manner that imposes obligations on us without our prior written consent.
15. Governing Law
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws principles.
EU Consumer carve-out. If you are an EU Consumer, the application of Ukrainian law does not deprive you of the protection afforded by the mandatory provisions of the law of the country of your habitual residence (Article 6 of Regulation (EC) No 593/2008, Rome I).
16. Dispute Resolution
Before initiating any formal proceeding, the parties agree to attempt good-faith informal resolution. You must send a written description of the dispute to support@mymedica.me; the parties will negotiate in good faith for at least 30 days from the date of receipt.
If the dispute is not resolved through informal negotiation, the dispute will be submitted to the competent courts of Ukraine.
EU Consumer carve-out. Nothing in this Section limits the right of an EU Consumer to bring proceedings in the courts of the country where the EU Consumer is habitually resident or to rely on consumer protection mechanisms available in that country, including the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) where applicable.
17. Force Majeure
Neither party is liable for failure or delay in performing its obligations under these Terms (other than payment obligations) caused by events beyond its reasonable control, including acts of God, war, armed conflict, hostilities and consequences thereof affecting Ukraine, terrorism, civil unrest, epidemics, government actions, labor disputes, energy or infrastructure failures, internet or upstream provider outages, and natural disasters. The affected party must notify the other party as soon as practicable.
18. Modifications to Terms
We may amend these Terms from time to time. For material changes, we will provide at least 30 days’ prior notice by email to the address associated with your Account and through a notice within the Service. For non-material changes (such as clarifying language or fixing typos), updates take effect upon posting.
The “Last updated” date at the top of these Terms reflects the most recent revision. Your continued use of the Service after the effective date of an update constitutes your acceptance of the updated Terms. If you do not agree with an update, you must stop using the Service and may cancel any active Subscription before the effective date.
19. Notices
Notices to you will be sent to the email address associated with your Account or delivered through an in-Service announcement. Notices to us must be sent to support@mymedica.me. Notices are deemed received on the next business day in Ukraine after delivery.
20. Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable by a competent court, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
21. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, Acceptable Use Policy, Cookie Policy, and any additional written terms we present at checkout or in-Service, constitute the entire agreement between you and MyMedica regarding the Service and supersede any prior or contemporaneous agreement or representation.
22. No Waiver
A failure or delay by either party to enforce any right under these Terms is not a waiver of that right. A waiver of any provision must be in writing to be effective and applies only to the specific instance and purpose for which it is given.
23. Assignment
You may not assign or transfer these Terms, in whole or in part, without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, reorganization, or sale of substantially all of the assets to which these Terms relate, provided that the successor agrees to be bound by these Terms and that your rights under applicable consumer law remain unaffected.
